Dear Mr. Mukasa,

 

Many of us observers have been wondering what it is exactly that the UNAABOT and the UNAA Council of 8 really what other than of course to frustrate the UNAA President's agenda to clean UNAA's financial house.

 

It is increasingly looking as if the UNAA establishment (six of the eight council members absconding from their constitutional duties were on the previous council and all the other eight diligently working are newly elected), have not yet accepted the results out of the Dallas election two months later and will stop at nothing even if it means destroying the 25 year old Association they claim to love more than everybody whom one of them called the "Johnie Come latelies". So thank you for taking the time to articulate their position, there indeed must be hidden ghosts in the last 25 years that the establishment fears will be unearthed and exposed for all to see.

 

Now if you will, please allow me to respond you in specific details.

 

You write that, "In my humble opinion UNAA is currently going through a constitutional crisis of epic proportions."

 

Mr. Mukasa, what is the cause of this "constitutional crisis?" Is it a an ambiguous constitution as you would like us to believe which is being interpreted differently by different people or is it a UNAABOT that is determined to fight Mr. Brian Kwesiga – as it did to the then Presidential Candidate and is now doing to the elected UNAA President at all costs -- even if it includes circumnavigating a most sacred UNAA document, the constitution? Of which they are supposed to be the "guardians?"

 

What a casual observer of the UNAA 2013-election cycle will notice is that the UNAABOT never wanted Mr. Kwesiga to assume the UNAA Presidency (Why? I do not know) to begin with; they fought to have the constitution changed so that his rival could add more registrants past the constitutional deadline of thirty days; there is absolutely no ambiguity in this article of the UNAA Constitution.

 

9.6: The Electoral Commission shall...set the deadline for registration for voting, which shall be no later than thirty (30) days prior to the election;

 

To amend the UNAA Constitution or remove an elected official, the proposed amendment/Recommendation to impeach an official has to first get the required 2/3 votes in the UNAA Council before it is presented to the AGM for members to vote on it, if it fails, it can not be presented to the AGM. 

 

7.11: Vote Required For Action: Except for a motion to impeach or remove an Officer, Trustee or Member of the UNAA Council, the act of a simple majority of the UNAA council present at a meeting at which a quorum is present shall be the act of the full Council.

 

A motion to impeach or remove an Officer, Trustee or Member of the UNAA Council shall require the consent of at least two-thirds (2/3) of the full Council.

 

7.15: Removal: The UNAA Board of Trustees shall have the power to recommend to the UNAA Council the suspension or impeachment with cause any member of the Council and to present the Council's decision to a meeting of the full members of the Region that is represented by the impeached Member prior to presenting the decision to the next Annual General Meeting of the Association for review and final disposition.

 

13.1: Power to Amend Bylaws: The Membership or the UNAA Council or the Executive Committee shall have the power to initiate action to alter, amend and/or repeal these Bylaws or adopt new Bylaws, except that any such alteration, amendment, repeal or adoption shall first be approved by two-thirds [2/3] majority of the UNAA Council and then a simple majority of members present at an Annual General Meeting, with respect to which Notice of such purpose shall have been given to members.

 

Yet despite these very clear articles in the UNAA Constitution, the Chairman of the UNAABOT presented the proposed constitutional amendment (which had failed to get the required 2/3 votes in the then UNAA Council) to the Dallas AGM in clear violation of the UNAA constitution and thank God the UNAA Members had the good sense and judgment to vote that motion down and publicly reject the BOT Recommendations to violate the constitution. The UNAABOT then like it is now, made a spectacle of themselves. 

So for those who want to remove Council Member Mr. Kabagambe or Council Member Mr. Awichu or Council Member Ms. Nalugemwa, or even change the constitution, please take the time to gather the required 2/3 votes in the UNAA Council before wasting our time at the UNAA AGM in San Diego just like the BOT wasted members' time at the AGM in Dallas. 

 

Now when it comes to the issue of Rahim, according to the UNAA Constitution, the EC should have first tried and failed to resolve it after it was petition (It is worth noting that the UNAA Council 8 skipped the EC and went straight to their anti Kwesiga allies on the BOT in complete violation of the UNAA Constitution), then after failing they (the UNAAEC) would have approached the UNAA BOT for resolution (the UNAABOT never even gave the UNAAEC the courtesy of the EC carrying out their duties without undue influence), and all this should have taken place before the UNAA Elections in Dallas. 

 

9.9: Arbitration: Any electoral complaint that is not resolved by the Electoral Commission shall be referred to UNAA Board of Trustees for arbitration and resolution within four (4) weeks or before the elections, whichever comes first.

 

So, 1) a petition received AFTER the election, and 1) BEFORE election which of these events comes first? The petition and before elections comes first?; It seems with this particular UNAABOT, what is up is down and what is down is up

 

Mr. Mukasa, you state addressing the UNAA President that, "Do you Mr. Kwesiga believe in your heart of hearts that those who oppose you on the constitutional interpretation on the issues that are bedeviling UNAA today have a reading and comprehension impediment…make peace with them?"

 

Mr. Mukasa, the BOT does not have a reading and comprehension impediment, and yet they continue to violate time and again the articles of the constitution that are written in very plain English language, and further still, they are always against Mr. Kwesiga, when he was a candidate and now that he is President, even in very clear violation of the constitution. If they had any respect left after the debacle that was the AGM in Dallas, it is now all gone, for they have been exposed as naked.

 

Mr. Mukasa, you previously asked what would happen if UNAA was a real country where people had real power. During the elections, the term "Grand Ayatollahs" was introduced into the UNAA vocabulary, it seems if UNAA was a country, the country we would resemble is Iran, where unelected Grand Ayatollahs, who think they should be in charge of UNAA throughout their lifetimes as UNAABOT members want to tell the elected leaders what to do, just like Iran. I am just glad we have a President who is willing to stand by the constitution.

 

They UNAA BOT members are human and they obviously favored Mr. Ssennoga in the elections, and if they can not find it in themselves to realize that Mr. Kwesiga actually won, that the people rejected their moves at the AGM to rig the election in favor of Mr. Ssennoga, to put their egos aside and to work with the elected President by doing their job of interpreting the constitution instead of rewriting it and if they instead wish they were still serving Mr. Ssennoga and not Mr. Kwesiga, they would do this organization a big favor if they could honorably resign. They have done enough damage in their one-year of service.

 

If they cannot find it within themselves to resign, may I humbly advise them to make peace with our elected President or at the very least come to peace with the fact that he is now the elected President, much as they might not have wanted him in the office to begin with?

 

Mr. Mukasa, let us give the UNAABOT the benefit of the doubt and assume (despite the overwhelming evidence) that they made genuine mistakes in reading the constitution, once a mistake has been poin
